Abstract
This Law regulates measures for the proper management and protection of the renewable resources of the sea, methods and activities of catching, breeding, processing and traffic of fish and other marine organisms, administrative and inspection supervision, penal measures as well as other issues important for sea fishing on the territory of the Herzegovina-Neretva Canton (Federation of Bosnia and Herzegovina. The purpose of this Law is to ensure the proper and responsible management and protection of fish and other marine organisms, as renewable resources of the sea, and the development and development of the activities of catching, catching, growing, processing and trading fish and other marine organisms. Fishing sea includes coastal sea waters.
This Law and other deriving by-laws adopted on its basis, shall apply to all fishing vessels, as well as to all physical and legal entities that are engaged in the performance of aquaculture and fishing activities in the fishing sea, and trade in fish and other marine organisms on the territory of Herzegovina-Neretva Canton.
The text is divided into nine main thematic Chapters and a total of 51 articles. Titles of these Chapters are as follows: I. General provisions; II. Definitions; III. Application of the Law; IV. Measures for marine biological wealth management; V. Fisheries regulation measures; VI. Fish and other marine organisms cultivation management measures; VII. Administrative and inspection supervision; VIII. Penalty provisions; and IX. Transitional and final provisions.
For the purpose of sustainable management of biological resources, at the proposal of the Municipal Council of the Municipality of Neum, the Minister may prescribe: a) limitation of fishing time for certain types of fish and other marine organisms, permanent or temporary ban of all or certain species or all or certain types of fishing; b) structural and technical characteristics, marking, manner of use and purpose of certain types of fishing tools and fishing equipment; c) prohibition of issuing authorizations for small-scale coastal fishing and licenses for breeding fish and other marine organisms; d) the permitted quantity of catch or collection in the fishing sea, the permitted amount of catch or collection per one approval. Small coastal fishing is defined in article 12. Articles 27-37 are regarding the mariculture and all related issues and rules (a legal and physical person-artisan engaged in mariculture is obliged to act according to the provisions of this Law after the entry into force of the new Spatial Plan of the Municipality of Neum). For the purpose of protection against pollution and damage to biological resources, the provisions of the substantive laws regulating the area of water and environmental protection in Herzegovina-Nerevan Canton must be applied. In order to prevent pollution of the sea and endangering the biological renewable resources of the sea, it is prohibited to keep and/or use the following substances on the vessel during fishing: a) toxic, corrosive and intoxicating substances; b) devices for fishing using electric current; c) explosives; d) substances that, in combination with other substances, can produce an explosion; e) pneumatic blanket and similar tools for collecting shells embedded in rocks. It is also forbidden to discharge dangerous substances and materials, polluting materials and waste water from fishing vessels.
