Abstract
The Agricultural Marketing Act, 2018 deals with the development and extension of agricultural marketing system and consists of seven Chapters: I. Preliminary; II. Declaration of Notified Market, Licence, Management, etc.; III. Constitution of Committees and Functions thereof; IV. Notified Grains, Market Charge, etc.; V. Offence and punishment; VI. Cognizance of Offence, Trial, Appeal, etc.; VII. Miscellaneous.
Chapter I provides the definitions and lays down the functions of the Department of Agricultural Marketing including development of agricultural marketing and commerce, creating market linkages, price support, quality control and monitoring etc. Chapter II empowers the government to declare any market to be a notified market for purchase and sale of the agricultural produce. The Act requires a license to be obtained by any exporter, importer, dealer, miller, supplier and processor of agricultural produce or any operator of any warehouse or cold storage. Chapter III allows the government to constitute Agricultural Marketing Coordination Committee at the national, district, sub-district and market level for carrying out the purposes of this Act. Chapter IV allows the government to declare one or more agricultural produce as notified grains during emergency or crisis. It can also determine the market charge and fees for a notified market.
Chapter V describes the various offences and punishment for such offences. Chapter VI deals with offences committed by an institution, jurisdiction of magistrate and powers of mobile court. Chapter VII provides for settlement of disputes by the Director General among the various market functionaries such as traders, farmers, purchasers and sellers, owners of warehouse and cold storage, stockists etc.
