Abstract
This Act, consisting of 70 sections, provides for the Bangladesh Atomic Energy. After the implementation of this Act, the government shall establish an authority named Bangladesh Atomic Energy Regulatory Authority for implementing the purposes of this Act. The Authority is a statutory body and shall have the power to acquire, possess or transfer its movable or immovable property. This Authority shall perform the following functions, namely: ensuring that the safe and peaceful use of nuclear energy is being adopted in accordance with the provisions of this Act; prepare and enforce necessary standards, codes and manuals; allow, grant, or cancel licenses, certificates, registrations, etc. for designing, constructing, commissioning and decoding, on radioactive waste disposal; ensuring nuclear safety, radiation protection, security, safeguard, import and export control and physical protection for the above mentioned activities; prepare and implement regulatory activities and evaluation procedures; implement the programme for conducting inspection; evaluate, inspect and licensing; formulate guidelines for the implementation of enforceable activities and to take action; determine exemptions from regulatory control of an establishment or nuclear installation; determine obligations including financial matters; determine the level of radioactivity in the soil, water and air, and during any feeding for humans and animals, etc.
The Act is divided as follows: Preliminary (Chap. 1); Authority (Chap. 2); Approval method (Chap. 3); Safety and Security of Radioactive Materials, Nuclear Security, Radiation, Protection, Quality Assurance, Physical Protection, Illegal Trafficking and Safeguard (Chap. 4); Urgent preparation and remedial measures (Chap. 6); Nuclear liability and circumference (Chap. 7); Inspection and action (Chap. 8); Criminal, Trial and Punishment (Chap. 9); Miscellaneous (Chap. 10).
