Bangladesh Patent Act, 2023 (Act No. 53 of 2023).

This Act provides for the registration, protection and governance of all matters related to patents in Bangladesh. Chapter 2 contains provisions relating to the Department of Patents, Industrial Designs and Trademarks, the persons entitled to apply for a patent and priority date. Chapter III lays down the matters that are outside patent protection. Chapter IV provides for the procedure of patent application, amendment of application, withdrawal and reapplication, foreign patent application, publication, opposition to patent or application of patent, patent searching, and granting, refusal or modification of patents. Chapter V contains the rights of patent owners, patent ownership change and assignment, cancellation and revocation of patents. Chapter VII makes provisions in respect of enforcement of patents, compulsory licensing, and use of patents by the government. Chapter VIII contains provisions for utility model patents. Chapter IX and X provide for enforcement of patent rights and legal proceedings. Chapter XI lays down the powers of the Director General. Chapter XII mentions certain exceptions.
