Abstract
The Act provides for the construction, maintenance, removal, management and control of embankments and water-courses in order to improve the drainage and prevent potential floods in the land. The Engineer appointed by the Government shall consider every project for building, reinforcing or removing an embankment and shall report it to the Irrigation Superintending Engineer for approval. Within thirty days appeal against the project may be presented to the same Irrigation Superintending Engineer who, after further inquiries, may decide to authorize, deny or modify the related project (arts. 10-11). All the embankments and water-course shall be vested to the Government as per article 4 (clauses 1-2). If the Engineer considers that trees must be felled or land expropriated in order to complete the waterworks, he shall report his findings to the Collector of the district involved who, on his part, shall submit such report to the Government trough the Commissioner of the appointed Division in order to take possession of aforesaid trees or land property as per the 1982 Acquisition and Requisition of Immoveable Property Ordinance. Any individual claiming that intervention on land and embankments procured damage may apply for compensation, which shall be granted as per article 31.
