Abstract
The Trademarks Act, 2009 is an Act relating to trademark of goods and services in Bangladesh. The Act provides for the Trademarks Registry, the Registrar of Trademarks and conditions of registration. It further provides for the procedure of registration of a trademark and the effect of such registration. The definition of goods includes agricultural products and herbal plants.
The Act also contains provisions for Assignment and Transmission of registered and unregistered trademarks. The Registrar has the power to cancel, vary, correct or rectify the Register in respect of a trademark. The Act provides for registration of certification trademarks and lays down the procedure for the same. The Act also provides for Offences and Penalties and the procedure for institution of suits for infringements or passing off.
