Abstract
This Law governs the conditions and procedures for the registration of marks and geographical indications, the rights arising therefrom and the protection of those rights. The Minister of Agriculture and Forestry registers the producers of agricultural and food products and the protected geographical indications for entering thereof in the European Register of Protected Geographical Indications.
The Law consists of seven Chapters divided into 88 articles dealing with the following matters: general provisions (I); marks (II); geographical indications (III); international registration (IV); community mark (IVa); protection of rights in marks and geographical indications (V); additional provisions (VI) and transitional and final provisions (VII).
The Patent Office shall keep the State Register of marks which shall contain data on all mark registrations and the State Register of Geographical Indications which shall contain data on all registrations of geographical indications. A mark may be a trademark, a service mark, a collective mark or a certification mark. Applications for the registration of marks shall be filed with the Patent Office and must contain: (i) request for registration; (ii) name and address of the applicant; (iii) representation of the mark; (iv) list of the goods and/or services for which the registration is requested. Applications for the registration of geographical indications are filed with the Patent Office. An application relates to one geographical indication only and must contain: (i) the registration request form; (ii) the name and address of the applicant; (iii) the appellation of origin or the indication of source; (iv) the designation of the goods; (v) the designation of the borders of the geographical locality; (vi) an account of the recognized properties or peculiarities of the goods and their relationship with the geographical environment or geographical origin.
