Abstract
This Law consisting of 16 articles aims to establish a legal framework for the protection of geographical indications in Bahrain, aiming to prevent unauthorized use and misrepresentation of products' origins. It emphasizes the importance of accurate labeling and the preservation of the reputation and quality associated with specific geographical areas. Geographical indication are defined as any distinctive sign or combination thereof, such as words, names, symbols, or colors, associated with the quality, reputation, or other essential characteristics derived from a specific geographical origin within a WTO member-state or its region. Article 2 prohibits any individual or entity to engage in activities that may mislead the public regarding the geographical origin of a product, including using any means to falsely indicate its origin or employing a geographical indication in a manner that constitutes unfair competition. Under article 5 the department responsible for industrial property will establish a register known as the "Geographical Indications Register," where it will document accepted geographical indications, related data, and all actions taken in accordance with the provisions of this law, its executive regulations, and implementing guidelines. While Article 5 bis prescribes the causes why geographical indication shall not be registered nor enjoy the protection. Regarding inspections, Article 10 stipulates that employees appointed by the Minister to enforce this Law will have access to relevant premises, and individuals authorized by the Minister of Justice, in coordination with the Minister overseeing industrial property, will act as Judicial Control Commissioners for offenses within their jurisdiction. Article 13 deals with offences in case of violations.
