Energy Efficiency (Standards and Labelling) Act (Chapter 233)

This Act establishes the primary statutory framework for regulating the energy efficiency and performance standards of designated electrical commodities within Brunei Darussalam. The legislative purpose of this foundational text is to institutionalize mandatory energy conservation and environmental protection measures nationwide. It seeks to curb national energy waste and lower carbon emissions by establishing a strict regulatory regime over the internal trade, import, manufacture, distribution, and commercial display of specified electrical equipment that does not conform to minimum technical benchmarks.
The Act institutes clear administrative and governance mechanisms, granting explicit powers to the Minister and a designated Authority to execute its mandates. It outlines operational prerequisites for the internal trade of regulated electrical equipment, prohibiting any person or business entity from supplying, importing, or displaying registrable goods unless they are formally enrolled as registered suppliers and the specific product models have been granted official certification. To safeguard consumer protection and ensure transparency, the text establishes a central Register of registered suppliers and products, and legally mandates that all compliant equipment must bear a standardized energy label detailing specific performance indicators before being offered for sale or public distribution.
Operationally, the legislation details procedural rules for compliance monitoring, data collection, and physical market enforcement. Authorized officers are legally empowered to demand the production of technical files, enter commercial premises to conduct inspections, and seize non-compliant electrical goods. Registered suppliers are required to maintain accurate technical documentations and testing records for specified periods. To deter market infractions, the Act prescribes comprehensive legal proceedings, defining specific offences and administrative penalties—including substantial monetary fines and terms of imprisonment—for trading unregistered goods, manipulating registered technical specifications, or displaying fraudulent energy labels. Furthermore, it contains provisions enabling the Minister, with the consent of His Majesty the Sultan and Yang Di-Pertuan, to grant special exemptions or enact detailed subordinate regulations to carry out the provisions of this Act.
