Abstract
This Order consisting of 8 articles amends the Land Code as follows (i) the definition of "non-citizen" is updated to exclude persons of no national status; (ii) the new definition of Minister refers to the Minister of Development; (iii) national status now includes citizens or nationals of Brunei or any other country; (iv) substitution of Section 3B introducing new obligations for non-citizens to declare land interests within 12 months; (v) substitution of Section 3C which allows inheritance by non-citizens; (vi) inserted new Sections (3D, 3E, and 3F) that restrict non-citizens to owning only one freehold property for residential use, require former citizens to sell their land within ten years or convert it to a leasehold, and grant the Minister authority to set guidelines for maximum lease periods; (vii) the new Section 32A prohibits nominee arrangements where citizens hold land in trust for non-citizens or persons of no national status.
