Abstract
This Regulation, consisting of 19 Sections, bans the import of (a) all species of sharks as well as any species of fish determined by the Director of Fisheries; (b) live fish listed as protected species under the Convention of International Trade of Endangered Species of Wild Fauna and Flora (CITES) if without a CITES export permit issued by the Management Authority of the exporting country and CITES import permit issued by the Management Authority. The Regulation establishes for the importer (a) to be registered with the Fisheries Department at the Ministry; (b) has a valid live fish import license; (c) has premises with quarantine facilities approved by the Fisheries Department; (d) complies with the fish disease control measures. The Regulation provides for both consignment in the exporting country and consignment in Brunei Darussalam, with particular regard to (i) conditions for the handling and packaging; (ii) health certificates and CITES import/export permits; (iii) approved fish farms; (iv) absence of diseases listed by OIE on the fish farms of origin; (v) inspections of consignments; (vi) quarantine requirements and related records; (vii) inspection and sampling of live fish for disease analysis and monitoring; (viii) rules on the process of disposing of live fish infected with disease, disinfecting tanks, ponds, cages, and equipment; (ix) procedures in case of a high death rate.
