Abstract
This Decree regulates the provisions of item VII of § 2, § 3 and § 5 of art. 2 of Law No. 8.001 of 13 March 1990, establishes the percentage of distribution of Financial Compensation for the Exploitation of Mineral Resources. The financial compensation provided for in this article will be linked to the CFEM revenue of each mineral substance. The distribution of 15%, for the Federal District and the Municipalities affected in their territories by the mining activity will occur as follows: I - 55% when they are cut by infrastructures used for the rail transport of mineral substances; II - 3% when they are cut by infrastructures used for the pipeline transport of mineral substances; III - 7% when affected by port operations and loading and unloading of mineral substances; It is IV - 35% to those where mining structures are located that enable the industrial use of the deposit, such as overburden and tailings piles, processing plants, tailings basins, among other structures provided for in the Economic Use Plan - PAE or in an equivalent instrument, duly approved by the National Mining Agency - ANM.
