Decree No. 63.262 approving the new Regulation on the Granting of Rights for Water Resources Use.

This Decree approves the new Regulation of Articles 9 to 13 of Law No. 7.663, establishing the guidelines for the State Policy on Water Resources and the Integrated Water Resources Management System. Annex establishes the new Regulation of the Granting on Rights for Water Resources Use. The Department of Water and Electric Energy - DAEE may allow through the grant of water resource use the following activities: execution of works or services that alter the regime, quantity and quality of surface or underground water resources; execution of works for extraction of groundwater; diversion of superficial or underground water from its course or deposit; discharge of effluents into the bodies of water. The application for obtaining a grant shall comply with specific provisions of the DAEE Ordinance. The uses in water resources, for implementation of new projects, will be subject to prior approval of DAEE feasibility, as provided by the granting authority.
The person who got the right of water use has to: operate the hydraulic works according to the conditions determined by the DAEE; maintain works and services in perfect conditions of stability and safety; respond for damages caused to the environment and to third parties; preserve the physical and chemical characteristics of the groundwater, abstaining from alterations that could harm the natural conditions of the aquifers or the management of those waters; install and operate hydrometric stations and equipment, submitting to the DAEE measured data, in the form recommended in the granting act and in the procedural standards established by the DAEE; etc.
