Abstract
This Decree regulates Act No. 6.938 (on environmental Policy) and Act No. 6.902 (creating protected areas). It consists of 46 articles specifying procedures to be applied by competent authorities in order to preserve natural ecosystem. It establishes duties, competencies and composition of environmental authorities in order to guarantee the preservation of natural resources. The construction, installation, expansion and operation of establishment of activities utilizing environmental resources, considered as effectively or potentially polluting, as well as enterprises causing environmental degradation, will depend on previous environmental licensing of the competent state body that is a member of Sisnama, without prejudice to other legally enforceable licences. Title III specifies offences and penalties for environmental illegal activities.
