Abstract
This Law establishes the State Policy on the Rights of People Affected by Dams (PEAB), with the aim of safeguarding the rights of those people who suffer direct or indirect damage as a result of dams, discriminating against the rights of People Affected by Dams (PAB), as well as providing for the Programme on the Rights of People Affected by Dams (PDPAB) and establishing rules on social responsibility. The State Policy PEAB will have one collegiate body at state level, of an advisory and deliberative nature, with the purpose of monitoring, supervising and evaluating its formulation and implementation.
The Programme PDPAB will be drawn up at the developer's expense, with the aim of providing for and ensuring the rights established in the PEAB, with specific programmes aimed at: women, the elderly, children, people with special needs and people in situations of vulnerability, as well as domestic and farm animals; indigenous populations and traditional communities; construction workers; the impacts on health, environmental sanitation, housing and education in the municipalities that will receive the construction workers or those affected by any leakage or rupture of the dam; compensate for losses resulting from the filling of the reservoir or the leakage or rupture of the dam; to fishers and fishing activities; communities receiving the resettlement or relocation of affected families; other activities or situations defined in the terms of the regulations.
