Abstract
This Law establishes the requirements for combating food waste and donating surplus food for human consumption. It specifies that establishments dedicated to food production and supply, including fresh food, processed products and ready-to-eat meals, are authorized to donate food surplusses that are not marketed and are still suitable for human consumption. The donated products must meet the following criteria: they are not expired and are kept in good storage conditions specified by the manufacturer; their integrity and health safety are not compromised, even if there is damage to their packaging; their nutritional properties and health security have been maintained. The food donation must be made directly, in collaboration with the public authorities, or through food banks, other social assistance charities certified under the law or religious entities and will be free of charge. The beneficiaries of the donation are single persons, families or groups in a situation of vulnerability as regards food or at nutritional risk.
During the validity of the public health emergency resulting from the Coronavirus 2019 outbreak, covered by Law No. 13.979 of 6 February 2020, the federal government will preferentially purchase through the Food Acquisition Programme (PAA) that portion of the production of family farmers and artisanal fishermen, which is marketed directly as a result of the spontaneous or compulsory suspension of the operation of trading places and through other direct marketing due to measures to combat the Covid-19 pandemic.
