This Law establishes administrative infractions to the environment and respective sanctions and the administrative procedures for their investigation at the State level. As a preliminary stage to the administrative procedures for investigating infractions, the environmental agency will prioritize the establishment of a guidance procedure with the objective of determining actions to be adopted. An administrative environmental infraction is considered to be any action or omission that violates the legal rules for the use, enjoyment, promotion, protection and recovery of the environment. Administrative environmental infractions will be investigated in a specific administrative process, ensuring contradictory proceedings and full defense.
