Abstract
This Law establishes a prohibition on the industrial reconstitution of imported powdered milk and other imported dairy derivatives for human consumption within the State of Santa Catarina. Its main objective is to regulate the dairy processing sector by preventing industries and dairy producers from reconstituting imported products such as powdered milk, whey powder, and compound milk into fluid milk or similar products intended for the local market. The law seeks to control production practices in the dairy industry and ensure that commercially processed dairy products comply with specific origin and quality standards. It also clarifies that this restriction does not apply to products sold directly to final consumers in retail packaging for domestic use, provided they meet labeling regulations. Additionally, the law aims to protect the local dairy production chain and strengthen regulatory enforcement through the establishment of sanctions for non-compliance. It provides for penalties such as the seizure of reconstituted products, the imposition of fines, and the suspension or cancellation of business registration, with due process guarantees. The revenue from fines is allocated to the State Fund for Rural Development, to be reinvested in programs supporting and strengthening the local dairy sector.
