Abstract
This Law establishes the legal framework for the regularization of rural land occupations on non-public (non-devoluta) lands owned by the State of Goiás. It authorizes the State Executive to regularize occupations based on defined concepts such as rural property use, peaceful occupation, effective cultivation, and family farming. The law applies to occupations existing until 31 December 2019 and requires proof of direct exploitation of the land by the occupant or their predecessors. It explicitly recognizes small-scale agriculture, subsistence farming, and rural tourism as legitimate forms of land use, thereby linking land tenure regularization to livelihoods and rural economic activities. The law provides three main mechanisms for regularization: donation, direct sale, and concession of a real right of use. Donation is reserved for small rural properties under family farming, subject to strict eligibility criteria such as exclusive reliance on the land for subsistence and absence of other property ownership. Direct sale requires payment based on the market value of the land (excluding improvements), with flexible terms including installments or discounts for lump-sum payment. Alternatively, concessional use rights may be granted for up to 35 years, subject to compliance with contractual obligations and public interest. The law also includes provisions on georeferencing, fee exemptions for small properties, administrative oversight, and amendments to prior legislation governing urban land regularization.
