Abstract
This Law establishes the State Policy for Payment for Environmental Services (PEPSA) in the biomes of the State of Tocantins and defines the respective concepts, objectives and principles for its implementation. This Law applies to individuals or legal entities, under public or private law; occurs in a coordinated manner with other sectoral and environmental policies, in particular with those established in Federal Laws No. 14.119 of 13 January 2021, No. 12.187 of 29 December 2009 and State Law No. 1.917 of 17 April 2008.
The specific objectives of PEPSA aims at creating instruments for: a) economic and fiscal incentives aimed to stimulate the preservation, conservation, maintenance and increase of programmes and projects to reduce greenhouse gas emissions and maintenance and provision of environmental services; b) management, control, registration and planning, enabling the execution of programmes and projects aimed at reducing greenhouse gas emissions and the maintenance and provision of environmental services; authorize the use of assets, goods or rights, derived from actions carried out in the State or carried out by Tocantins that can be classified as environmental services; check the economic arrangement necessary to make payment for environmental services to the provider; structure and strengthen the actions of public authorities in maintaining the integrity of ecosystems and the well-being of the population of the State of Tocantins, valuing the actors and activities responsible for the preservation, conservation, maintenance and increase of environmental services; create governance structures to encourage the preservation, conservation, restoration, maintenance and increase of environmental services; contribute to the State's access to financial resources within the jurisdictional carbon market and other new markets, being free to present basic concepts and enable participation through regulation; promote sustainable development, safeguarding the social and cultural integrity of populations; encourage environmental education actions, projects and programmes; recognize and share, fairly and equitably, and in a transparent manner, the benefits arising from the implementation of the State Policy for Payment for Environmental Services, in accordance with the socio-environmental principles provided for in this Law; ensure the transparency of information relating to the provision of environmental services, allowing society to participate; establish data and information management mechanisms necessary for the implementation and monitoring of actions for the full execution of environmental services; encourage the establishment of environmental services markets; continually seek sustainable development; promote national and international cooperation with a view to the integration and recognition of activities, actions, services, products and credits resulting from the implementation of PEPSA at municipal, state, national and international levels.
