Abstract
This Resolution, consisting of 12 articles, provides for the environmental specific licensing for activities of seismic data acquisition in maritime and transitional zones. These activities will be subject to environmental licensing as they are potentially causing environmental impacts, which will comply with specific rules due to their temporary nature, mobility and the absence of fixed installations. The environmental licensing of seismic data should comply with the following steps: 1. referral of the FCA by the entrepreneur; 2. framework of activities by IBAMA, considering the following classes: a) Class 1 Surveys in depth of less than 50 m or in areas of environmental sensitivity, subject to the elaboration of Plan for Environmental Control of Seismic activity (PCAS) and Environmental Studies of Seismic/Seismic Environmental Impact Report (EAS/RIAS); b) Class 2 Deep surveys between 50 and 200 m, subject to the elaboration of PCAS and EAS/RIAS; c) Class 3 Surveys in excess of 200 m, subject to the preparation of PCAS; 3. issuance of the Terms of Reference by IBAMA, within 15 working days, counted from the date of protocol of the request; 4. delivery of documentation by the entrepreneur, together with the application of LPS; 5. assistance by the developer of clarifications and additional information, if requested, within a maximum period of four months, counted from the receipt of the respective notification, which may be extended, if justified, agreed with IBAMA and required up to 30 days before its expiration; 6. manifestation of IBAMA by the deferral or rejection of the LPS.
