Environmental Planning and Protection (Amendment) Act (No. 6 of 2024).

This Act makes amendments in the Environmental Planning and Protection Act by inserting a definition of the environmentally sensitive area in Section 2; amending Section 11 regarding the penalties for starting work without first obtaining a Certificate of Environmental Clearance and inserting new penalties for breaching the conditions of the Certificate of Environmental Clearance under subsections (3) and (4); and amending several sections regarding the penalties for the breach of provisions related to the Environmental Management Plans and Environmental Impact Assessments; protection of the ozone layer; pollution control permits; discharge of any hazardous substances into any waters or any segment of the environment; damage to the environment and death or harm to persons; discharge of pollutants into a water resource; obstruction of environmental officers; and breach of regulations. Furthermore, this Act inserts a new section 60A regarding special procedures for certain offences.
