Abstract
These Regulations implement provisions of the Forestry Act, 2010 in respect of, among other things: leases of 99 years in respect of land in a forest reserve, protected forest and conservation forest for purposes other than utilization of forest produce under section 17 of the Act; permits to remove timber, non-timber or forest produce; permit to harvest protected tree; timber licences; forestry on private lands; application for a hunting licence in respect of wild birds and wild animals in the forest estate; prevention and fighting of forest fires; development of forests and forest management plans; forest roads; and recreation in forests.
Every application for a hunting licence in respect of wild birds and wild animals in a forest reserve, protected forest, conservation forest or any other land managed by the Forestry Unit under the Act must be made pursuant to section 8 of the Wild Birds Protection Act and section 4 of the Wild Animals Protection Act. The Regulations set out the contents of a forest management plan and empower the Director of Forestry to determine the allowable annual cut for any: (a) forest reserve; (b) area within a forest reserve and the boundaries thereof; (c) protected forest; or (d) conservation forest. Standing timber from forest estates may not be sold except under the conditions specified in these Regulations. The Director may also establish standards and operational procedures for the implementation of forest practices with respect to any a wide variety of matters including: (a) biological diversity; (b) EIA prescriptions; (c) timber quality; (d) soil and water conservation; (e) timber harvesting; (f) non-timber forest products; (g) afforestation and reforestation; (h) establishment of forest plantations; (i) carbon sequestration; (j) silviculture; and (k) invasive species management and control.
