Forestry Regulations, 2014 (S.I. No. 38 of 2014).

These Regulations, made by the Minister, in exercise of the powers conferred by section 34 of the Forestry Act, make provision with respect to a, among other thing; leases, licences and permits to be granted pursuant to the Act; forestry on private lands; forest fires and burning permits, forest management plans; forest roads and forest recreation.
The Minister may issue, under section 17 of the Act, leases to Governmental and non-governmental agencies of The Bahamas for a period of time not exceeding 99 years for the use of land within a forest reserve, protected forest and conservation forest for purposes other than utilization of forest produce. Permits may be obtained for the removal of timber, non-timber or forest produce or the harvesting of a protected tree. An application for a licence for large scale operations shall be accompanied by an Environmental Impact Assessment study and a Business and Forest Management Plan. The Regulations set out conditions under which a licence shall be issued. They also provide for hunting licences in respect of wild birds and wild animals in the forest estate (a protected forest area managed by the Forestry Unit).
A forest management plan shall contain the particulars as set out by these Regulations, including: the location of any water bodies, water reserve areas and provisions for protection of wildlife, the maintenance of ecological services, the preservation of habitats, the conservation of water and soil and unique physical attributes. It shall be the duty of the Director of Forestry to prepare and implement forestry development programmes and determine the allowable annual cut for any: (a) forest reserve; (b) area within a forest reserve and the boundaries thereof; (c) protected forest; or (d) conservation forest. The Regulations furthermore, among other things, prescribe conditions for the sale of timber from forest estates; establishment of best forest practice in respect of, among other things, biological diversity and soil and water conservation; forest research; a register of licences and permits; and restraining orders.
