Abstract
This Act is enacted to prevent and combat corruption effectively and enhance transparency and accountability of governance. The Act shall apply to public entity, corporation, person including nongovernmental organization, foundation, trust, charity and civil society using public resource.
The Anti-Corruption Commission shall be established in accordance with the provision of the Constitution, which shall be an independent authority and supported by a secretariat. The power and function of the Commission include: (a) Take all necessary actions to prevent and combat corruption; (b) Investigate on its own initiative any suspected attempt or conspiracy to commit any act of corruption or whenever there is evidence of corruption; (c) Investigate against a person abroad accused of corruption in Bhutan or non-Bhutanese residing in Bhutan charged in their countries of origin for corruption; (d) Visit for the purpose of inspection any place, examine any document and ask for such information and document, original or a copy, as it deems fit; (e) Monitor the implementation of anti-corruption national strategy, plan and programme by public and private entities.etc. Any person has the right to lodge with the Commission a complaint against a public servant, public entity or other person who has committed or is attempting to commit an offence of corruption; (f) Examine the legality and the administrative correctness of acts which involve property entitlement; etc. The Act further makes provisions, inter alia, for: procedure for a complaint, reporting of false Information, investigation, international cooperation, various offences and penalties.
