Abstract
These Rules are framed to implement the provisions of the Biodiversity Act of Bhutan, 2022. Chapter 1 contains the title, commencement date, extent and objectives. Chapter 2 lays down the composition of the Competent National Authority (Authority) and rules of procedure of the Authority. The powers and functions of the National Focal Point are provided. Chapter 3 contains rules in respect of conservation of sustainable use of biological resources, including ex-situ conservation, invasive alien species and restricted genetic resources. Chapter 4 provides for the procedure for application for plant variety protection, the process of examination, publication of opposition and grant of registration or assignment.
Chapter 5 contains the rules of procedure for obtaining access to genetic resources. Chapter 6 makes rules in respect of access to traditional knowledge associated with genetic resources. Chapter 7 lays down the rules regarding the fair and equitable sharing of benefits from commercial use of genetic resources. Chapter 8 states the obligations of the National Focal Point as the administrator of the Bhutan Access and Benefit Sharing Fund. Chapter 9 provides for the rules of registry to be maintained containing details on access and utilization of genetic resources and associated traditional knowledge. The users of genetic resources must maintain record as stated therein. Chapter 10 identifies the enforcement officers to monitor and regulate genetic resources and agencies for monitoring of access and benefit sharing checkpoint. Chapter 11 contains the offences and penalties and Chapter 12 contains the definitions and miscellaneous provisions.
