Abstract
These Land Lease Rules and Regulations 2018 are enacted in accordance with Sections 6(a) and 186 of the Land Act 2007, for a balanced and equitable socio-economic development, sustainable management of natural resources, well-being of the ecosystem and the importance of fostering sense of ownership and belongingness.
There shall be three types of lease depending on its term: (1) Temporary lease; (2) Short term lease; (3) long term lease. The concerned Dzongkhag or the Thromde shall have the authority to approve or reject the temporary lease. The concerned Dzongkhag or the Thromde shall have the authority to approve or reject the temporary lease. The National Land Commission Secretariat shall be the sole authority to approve or reject land lease for shortterm and long-term lease. The Land Management Division (LMD) under the Secretariat shall be the responsible division to deal with leasing of land.
Chapter 2 provides for the general provisions for lease of land. All natural resources falling within the leased land shall belong to the State. The State shall have the control and discretion to allot those resources. Any activities that are long term in nature shall not be allowed under temporary or short-term lease. Proposed land for lease shall be surveyed based on the National Coordinate reference system.
Specific requirements for lease of land for commercial agriculture are set up in Chapter 6. In addition to the general requirements under Chapter 2, the lease for commercial agriculture shall comply with the following requirements: (1) Leasing of land for activities related to commercial agriculture shall be based on the standard recommended by the Ministry of Agriculture and Forests; and (2) Submit a copy of Certificate of Registration for groups or cooperatives issued by relevant Department or Agency.
Chapter 11 provides for the lease management. The Dzongkhag or Thromde Land Sector shall be responsible for monitoring leased land quarterly. The monitoring shall be carried out in consultation with the relevant Stakeholders. The Secretariat shall issue LLC for short-term and long-term lease for all kind of activities. The National Land Commission Secretariat shall issue Land Lease Certificate (LLC) for short-term and long-term lease for all kind of activities.
