Abstract
These Development Control Regulations have been formulated as part of the Thimphu Structure Plan and its related Local Area Plans and Urban Design Plans, 2002-2027. They support the aims of the plan through the introduction of regulations and procedures. The jurisdiction of these regulations includes the area under the Thimphu Thromde (TT) and the Urban Control Zone (UCZ) as defined in the Thimphu Structure Plan. While the TT shall be the implementing authority in the thromde area, the Ministry of Works and Human Settlement (MoWHS) shall be the implementing authority for the area outside the thromde.
The Thimphu Thromde DCR contain five Sections: Administration (I); Procedures (II); Precinct Sanctions (III); Land Development And Subdivision Regulations (IV); Building Regulations (V).
Section – 2 A deals with the procedures for obtaining development/building permissions, which include two sub-sections, one concerning the layout and subdivision of land and the other concerning buildings. A person or body intending to carry out layout development in or over a land and/or subdivide and/or consolidate land or a building within the limits of the Timphu Tromde, shall obtain prior permission. The sub-sections contain the respective documents and particulars to be furnished along with the application, the fee, the validity of the approvals, liabilities and responsibilities of the applicant. Section – 2 B deals with procedures during development/building construction.
Section 4 contains requirements of access of the site to be developed, the standards for internal street widths, minimum plot sizes, required common areas, on-site physical infrastructure requirements and regulations related to tree plantation. A person or body intending to carry out layout development in or over a land and/or subdivide and/or consolidate land or a building within the limits of the Timphu Tromde, shall obtain prior permission. In the case of development in environmental conservation and forestry environments precincts, the application has to be accompanied by a no objection certificate from the National Environment Commission; In the case of the dzong precinct and agricultural environments, the application has to be accompanied by a no objection certificate from the competent authority. In all layouts larger than two hectares, or containing 40 or more plots, an area of at least 1% of the site shall be provided for garbage collection arrangement, electric substation, water supply storage reservoir/ pumping station, etc. Every site development shall provide channels at the lower elevation/ level of the site which collects rainwater runof and discharges this runof into public storm water drains. Every site development should include: A) Channels at the lower elevation/ level of the site which discharges rainwater runoff into public storm water drains. B) There shall be an underground water collection cistern at the lower portion of the site to store rainwater. It shall have the capacity for every 50sqm of land coverage of the site, a volume which can store 150 litres of water, collected from the site run-off. This water shall be used for landscaping, car washing and other non-potable uses.
