Abstract
This Act establishes the Botswana Energy Regulatory Authority as a body corporate, defines its functions and powers and provides with respect to the organization and operations of the Authority. The Act also provides with respect to licensing of regulated activities, i.e. generation, transmission and distribution of electricity and licensing of petroleum sector activities. The Authority shall be responsible for, among other things - ensuring sustainable and secure supplies in the regulated sector; setting and maintaining service standards; protecting and preserving the environment; ensuring that the regulation of the energy sector is done in accordance with the best international regulatory practice. The Authority shall establish and maintain a non-discriminatory and efficient regulatory framework to be followed by all regulated entities and licensees in the regulated sector. fees to be paid under this Act shall include a decommissioning fee, as may be required for environmental restoration. The Authority shall keep and maintain a national energy and water register
