Abstract
The Local Government Act lays down provision regarding Councils establishment, restructuring, declaration of Township and conferment of city status, powers and duties of Councils, constitution of Councils and Subordinate Authorities, procedures concerning Councils proceedings such as meetings, voting system, record keeping, public participation, privilege of immunity and regulation on staff appointment, revenues of Councils, Accounts and Audits.
Part IX is dedicated to the power of Councils to make bye-laws. The Act clarifies that the Council may after consultation with the community, make bye-laws for the area in respect of which it has been established, or any part of that area, in respect of (a) all matters as it considers necessary or desirable for the maintenance of the health, environment, safety and well-being of the inhabitants of that area or that part; (b) all or any of the functions set out in Schedule 1, and prescribing service and user fees set out in Schedules 3 and 4; and (c) prescribing, controlling and regulating levy on private land.
The Act continues giving powers under Part XI to the Minister to establish Local Authorities Public Accounts Committee and under Part XII to each Administrative District to establish a district or urban development committee.
Part VIII concerns Valuation and Rating of Properties, the Part establishes that the Minister may by regulations prescribe procedures for valuation, rating of properties, setting threshold and the fixing and levying of rates on different classes of land and properties within the jurisdiction of a Council.
