Abstract
These Regulations, made by the Minister of Environment, Wildlife and Tourism under section 18 of the National Meteorological Service Act, provide for the control of Ozone Depleting Substances (ODS). ODS are any chemical substance which destroys the ozone layer and is controlled under the Montreal Protocol and listed in Schedules I and Il of these Regulations. The Regulation prohibit the manufacturing and emission into the air of ODS. They place restrictions in the importation or exportation of (recycled) substances set out in column II of Schedule 1 ("controlled substances") or equipment or goods that are dependent on controlled substances. Importation or exportation of certain substances require a permit, whereas international trade in other substances is prohibited altogether. A permit holder shall not transfer a permit to a third party. There shall be kept a register of permits and permit holders have certain reporting obligations. The Regulations also provide for customs control and provide some rules regarding transportation of controlled substances.
