Abstract
The Act is divided into 8 Parts: Preliminary (I); Establishment and Functions of Land Boards (II); Financial Provisions (III); Grant of Customary Land Rights (IV); Grant of Land Rights under Common Law (V); Land Required for Public Purposes (VI); Land Board's Consent to Deal with Land (VII); General (VIII).
Part II, establishes the continuation of the Land Board, powers and functions, appointment of members, qualification, removal and suspension, meeting rules and quorum, confidentiality regulation. The Part also recognises that all the rights and title to land in each tribal area shall continue to vest in the Land Board in trust for the benefit and advantage of the citizens of Botswana and for the purpose of promoting the economic and social development of all the peoples of Botswana.
Part IV shall apply in relation to the granting, variation and determination of customary forms of land tenure, these include the discipline concerning the issue of deed to occupy land and a general ban to gran land to no-citizens. The provisions of Part V shall apply in relation to the granting and variation of common law forms of land tenure, such as the grant of land by way of lease.
Part VII establishes limits to deal and make transactions with rights conferred upon any person in respect of any grant or lease of any tribal land without the consent of the Land Board, the Part continues laying down provisions on consent request process. Part VIII, General, includes demarcation of boundaries, cancellation of customary land rights, and provisions on offences and legal proceedings.
