Abstract
These Regulations implement provisions of the Water Act.
The 38 Regulations are divided into 7 Parts: General (I); Proceedings of Water Apportionment Board (II); Application under the Act (III); Appeals (IV); Information (V); Advisory Boards (VI); Water servitudes (VII).
Regulation 5 concerns forms (set out in the First Schedule) for the application to the Water Apportionment Board under the Act, whereas regulation 13 concerns objections against the grant of a water right. Part IV provides for procedures of appeal to the Minister under section 31 of the Act. The Minister may, by Notice in the Gazette, create an Advisory Board either for the whole of Botswana or any portion thereof (reg. 21). The functions of the Advisory Board shall be to assist the Registrar or the Water Apportionment Board in the discharge of their functions under the Act. Regulation 29 provides for the creation of a certificate of servitude under section 26(4) of the Act.
