Decree No. 1426 of the Council of Ministers “On some issues of handling plant species.”

Regulation on the procedure for issuing permits for the removal of flora species and permits for replanting flora species establishes the procedure for issuing of permits for the aforesaid operation. In cases of removal, replanting of trees, shrubs with a trunk diameter of 12 centimeters or more at a height of 1.3 meters, Karelian birch growing on agricultural land, agricultural land of other categories of land (except for the removal, replanting of trees, shrubs during maintenance work of reclamation systems and separately located hydraulic structures), trees, shrubs growing on reserve land, issues related to issuing permits for removal, permits for replanting shall be considered by a commission to assess the feasibility of removing, replanting flora species growing on agricultural land, agricultural land other categories of land and reserve land. To obtain permission to remove or replant, a legal entity or natural person, including an individual entrepreneur, submits to the local executive and administrative body, and in the case of removal, replanting of flora species in the park, to the park administration, an application for removal, replanting of flora species indicating: for a legal entity - its name, payer registration number, location; for natural person –surname, first name, patronymic (if any), place of residence, including, for an individual entrepreneur – payer’s registration number; the proposed grounds for the removal and replanting of flora species, their types (species), quantitative parameters (pieces, linear meters, square meters) and their location; in case of transplantation of flora species - the planned location of flora species after transplantation. The validity period of the removal permit and transplantation permit is one year and is calculated from the date of its registration, respectively, in the register of removal permits and the register of transplantation permits. Regulation on the procedure for determining the conditions for the implementation of compensation measures establishes the procedure for compensation measures in case of removal of plant species. The implementation of compensatory measures is ensured by a legal entity or natural person, including an individual entrepreneur, interested in the removal of flora species.
