Abstract
This Decree validates 11 Regulations of administrative procedures in the field of protection and use of wild animals and wild plants covered by CITES Convention that are attached/annexed to the text.
Regulation on the administrative procedure carried out in relation to business entities “Obtaining a certificate of registration of an object for keeping and (or) breeding wild animals” (attached) envisages submittal of the following documentation: (a) copy of the hunting lease agreement; (b) a copy of the lease agreement for a forest fund plot for forest management; (c) certificate of accuracy of the information specified in the application; (d) an act on the compliance of the conditions of keeping wild animals with the requirements for their keeping established by law, indicating the maximum number of wild animals, the keeping and (or) breeding of which is possible at the inspected facility for keeping and (or) breeding wild animals; and (e) certificate of registration of the facility for keeping and (or) breeding wild animals.
Regulation on administrative procedure carried out in relation to business entities for “Obtaining a certificate of registration of wild animals kept and (or) bred in captivity” establishes terms and conditions for certification of registered wild animals kept and (or) bred in captivity (including their offspring that have reached the age of three months) belonging to species included in the Red Book of the Republic of Belarus or which are species covered by CITES. Business entities shall submit to certification authority the following documentation: (a) statement; (b) photographs of registered wild animals; (c) a copy of the certificate of inheritance - in case of inheritance of a wild animal; (d) a copy of the purchase and sale agreement - in case of purchasing a wild animal; (e) a copy of the exchange agreement – in case of exchange of wild animals; (f) a copy of the donation agreement – in case of receiving a wild animal as a gift; (g) a copy of the lease agreement (for free use) – in case of renting (receiving for free use) a wild animal; and (h) CITES permit - in case of import of CITES samples into the territory of the Republic of Belarus.
Regulation on administrative procedure carried out in relation to business entities “Obtaining a certificate of registration of a production facility where sturgeon species or products from them are produced, including caviar” shall submit the following documentation: (a) application for registration of a production facility where the production of sturgeon fish species and (or) products from them, including caviar; (b) certificate of accuracy of the information specified in the application; and (c) certificate of registration of the production facility where s carried out production of sturgeon fish species and (or) products from them, including caviar.
Regulation on administrative procedure carried out in relation to business entities “Obtaining permission to release non-pathogenic genetically engineered organisms into the environment for testing” requires submittal of the following documentation: (a) application for permission to release non-pathogenic genetically engineered organisms into the environment for testing; (b) Protocol on the admissibility (inadmissibility) of the release of genetically engineered organisms into the environment for testing or use for economic purposes; and (c) permission to release non-pathogenic genetically engineered organisms into the environment for testing.
Regulation on administrative procedure carried out in relation to business entities “Obtaining permission to remove wild animals and wild plants belonging to species included in the Red Book of the Republic of Belarus, from their habitat or growth" requires submittal of the following documentation: (a) for the removal of wild animals and wild plants belonging to the species included in the Red Book of the Republic of Belarus from their habitat and growth – withdrawal permit; (b) biological justification for the introduction of wild animals into the land (in case of their further introduction and (or) reintroduction into the land of the Republic of Belarus); (c) act on compliance of the conditions of keeping wild animals with the requirements for their maintenance (in case of capture of a wild animal for keeping and (or) breeding in captivity outside the Republic of Belarus); (d) conclusion that the removal of wild animals and wild plants does not threaten the survival of these species of wild animals and wild plants; and (e) permission to remove wild animals and wild plants of the age from one month to one year belonging to the species included in the Red Book of the Republic of Belarus from their natural habitat.
Regulation on administrative procedure carried out in relation to business entities “Obtaining permission for the introduction, reintroduction, crossing of wild animals” requires submittal of the following documentation: (a) application for permission to introduce, reintroduce, crossbreed wild animals; (b) biological rationale for the introduction of wild animals into the area; (c) conclusion on the admissibility of introduction, reintroduction, crossing of wild animals; and (d) permission for introduction, reintroduction, crossing of wild animals.
Regulation on administrative procedure carried out in relation to business entities “Obtaining permission to remove or replant objects of flora” requires submittal of the following documentation: (a) application for removal, replanting of flora species; (b) conclusion on confirmation of the inadequate quality condition of trees and shrubs; and (c) permission to remove or replant flora species.
Regulation on administrative procedure carried out in relation to business entities “Obtaining permission to move across the State Border of the Republic of Belarus species of animals and plants, their parts or derivatives therefrom covered by CITES” requires submittal of the following documentation: (a) application for a permit to move across the State Border of the Republic of Belarus species of animals and plants, their parts or derivatives thereof (derivatives) subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, dated March 3, 1973; (b) a copy of the contract or other document between the exporter and the importer indicating the terms of the transaction, transportation of animal and plant species subject to the CITES Convention, their parts and (or) derivatives; (c) permission from the administrative body under the CITES Convention of the importing country for import - in the case of export from the territory of the Republic of Belarus of CITES samples included in Appendix I to the CITES Convention; (d) permission from the competent authority of the importing country for import, corresponding to the requirements of the CITES Convention for permits and certificates - in the case of export from the territory of the Republic of Belarus of CITES samples included in Appendix I to the CITES Convention, if the importing country is not a party to the CITES Convention; (e) permission from the administrative body under the CITES Convention of the exporting country for export - in the case of export of CITES samples that were previously imported to the Republic of Belarus; (f) permission from the competent authority of the exporting country for export, meeting the requirements of the CITES Convention for permits and certificates - in case of export of CITES samples that were previously imported into the Republic of Belarus, if the exporting country is not a party to the CITES Convention; (g) a copy of the genetic certificate issued in the manner prescribed by law - in case of export of caviar from sturgeon fish species from the territory of the Republic of Belarus; (h) copies of documents confirming the legality of possession of CITES samples, depending on the method of possession; (i) a copy of the permit for the removal of wild animals and wild plants belonging to species included in the Red Book of the Republic of Belarus from their habitat - in case of removal of these wild animals and wild plants from their habitat on the territory of the Republic of Belarus; and (j) a copy of the permit for the removal of wild animals from their habitat - in case of removal of a wild animal from its habitat on the territory of the Republic of Belarus.
Regulation on administrative procedure carried out in relation to business entities “Obtaining a conclusion (permit) for the export from the customs territory of the Eurasian Economic Union of collection materials on mineralogy, paleontology, bones of fossil animals, wild living animals, individual wild plants and wild medicinal raw materials, rare and endangered species of wild living animals and wild plants included in the red books of the member states of the Eurasian Economic Union, mineral raw materials, information on the subsoil by region and deposits of fuel, energy and mineral raw materials on the territory of the Republic of Belarus included in a single list of goods to which nontariff regulation measures are applied in trade with third countries, provided for by the Protocol on non-tariff regulation measures in relation to third countries to the Treaty on the Eurasian Economic Union of May 29, 2014 (Appendix No. 7)" lists documentation meeting the established requirements.
