Joint Decree No. 5/6 of the Ministry of Natural Resources and Environmental Protection and the Ministry of Agriculture and Food validating the Regulation on management of unfit pesticides.

The Regulation consists of 10 Sections dealing with the following matters: 1) general provisions (sect. 1); 2) the modalities of management of unfit pesticides (sect. 2); 3) duties of the owners of unfit pesticides (sect. 3); 4) registration and inventory of unfit pesticides (sect. 4); 5) storage and transport of unfit pesticides (sect. 5); 6) repackaging of unfit pesticides (sect. 6); 7) the modalities and methods of identification of unfit pesticides (sect. 7); 8) fire safety and accident prevention in the process of management of unfit pesticides (sect. 8); 9) environmental monitoring in the location area of the storehouses of unfit pesticides (sect. 9); 10) environmental requirements for the sterilization of unfit pesticides (sect. 10). The present Regulation establishes environmental requirements for the management of unfit pesticides. Unfit pesticides shall be considered pesticides with the expired date of application, that became worthless under other circumstances, prohibited for the utilization or in the absence of quality certificate and shall be classified as hazardous waste. Management of unfit pesticides shall regard activity dealing with collection, storage, repackaging, transport and disinfection of unfit pesticides. Long-term storage of unfit pesticides shall mean safe storage for environment and human health for the period of over twenty-five years in special packages or in special storehouses. The registration of unfit pesticides shall be carried out for the purpose of qualitative and quantitative valuation thereof. Packages for the transport and storage of unfit pesticides must be made of plastic and must be hermetic. Joint storage of unfit pesticides and agricultural machinery and equipment, animal feed and other outfit shall be prohibited. Transportation of unfit pesticides in bulk shall be prohibited. Sterilization of unfit pesticides by means of burial thereof shall be prohibited.
