Abstract
This Ministerial Decree establishes legal status and legal protection of botanical collections, terms and conditions of creation, replenishment, storage, exhibition and trade thereof, and also set the criteria for classification thereof as particularly precious. Legal and natural persons can create botanical collection by removal of plants from their natural environment, purchase plants in accordance with purchase and sale contract, exchange, donation or other transaction, selection a part from already existing botanical collection and purchase of certified plants from certified botanical collection. The right of ownership of botanical collection shall be purchased by the originator thereof. Botanical collection shall be recognized as such after the registration thereof in the state register of botanical collections. The Ministry of Natural Resources and Environmental Protection shall issue certificate of botanical collection to the owner thereof. Botanical collection can be recognized as particularly precious by the Ministry in accordance with expert opinion.
