Abstract
Chapter 19 specifies the particulars for handling goods covered by the Convention on International Trade in endangered of Wild Fauna and Flora (CITES). The initial registration of seized, arrested or converted to state revenue of live and non-live wild animals and wild plants, their parts or derivatives (specimens), falling under the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington on March 3, 1973 (CITES), shall be carried out by customs in the manner established by this Instruction. A preliminary assessment of samples shall be carried out by customs officials in accordance with the taxonomic (systematic) categories of wild animals and wild plants according to the rates for determining the amount of compensation for damage caused to the environment by individuals and legal entities as a result of the illegal seizure or destruction of wild animals and the harmful impact on their habitat. In the absence of taxes for individual categories of wild animals and wild plants, a preliminary assessment is carried out in accordance with the materials of the CITES Secretariat or on the basis of current free (market) prices. After the specimens have been initially registered, customs authorities shall ensure that an application is submitted to the authorities implementing state control in the field of plant protection or the authorities implementing state veterinary supervision for an examination in accordance with the legislation. Customs authorities shall notify the Ministry of Natural Resources and Environmental Protection thereof no later than the working day after the seizure (arrest) of the specimens. The notification shall include the following information: (a) the name of the biological species of the sample and, if possible, the taxonomic (systematic) characteristics (class, order, family); (b) the number of samples; (c) a description of the sample, including size, colour, distinctive features, for live wild animals, if possible, age, sex, colour, identification marks or numbers, if any; (d) information about the sample, country of export, availability of accompanying documents, copies of the documents on the basis of which the seizure (arrest) was carried out; (e) information about the person from whom the samples were seized (arrested): for legal entities - full name, location; for natural persons - the surname, first name, patronymic (if any), series (if any) and number of the identity document, or the document for leaving the Republic of Belarus and (or) entering the Republic of Belarus, or a valid passport or other document replacing it, intended for travel abroad and issued by the relevant authority of the state of citizenship, or the usual place of residence of a foreign citizen or stateless person or an international organization, place of residence. A copy of the conclusion of the State Plant Quarantine Service or the State Veterinary Supervision Authority shall be attached to the notification.
