Presidential Decree No. 160 “On lease payment for public land plots.”

This Presidential Decree, with a view of improvement of the collection of lease payments for public land plots, establishes as follows: (a) the amount of annual lease payment for a plot of public land shall be determined by local government and administration of free economic zone, if not otherwise establishes by this Presidential Decree and other Presidential Legislative Acts in the following cases – 1) lease; 2) extension of the period of lease; 3) modification of lease contract; and 3) conclusion of lease contract with the winners of a tender; (b) the amount of annual rent is determined based on the cadastre value with the application of the coefficients (Annex 1) depending upon the type of functional use of the land plot (type of evaluation zone) (Annex 2), unless otherwise provided by this Presidential Decree; (c) payers of lease for public land plots enjoy the rights and fulfil the obligations established for taxpayers; (d) tax authorities exercise control over compliance with the procedure for calculation and payment of lease by legal entities and completeness and timeliness of payment of lease by citizens and individual entrepreneurs; (e) non-payment or incomplete payment of lease, late payment of lease shall be liable to legal and administrative proceedings.
