Abstract
Regulations to provide for various matters relative to the protection of plant breeders' rights made under the Protection of New Plant Varieties Act and implementing provisions of that Act. Regulation 3 provides for communication by the Registrar of negative decisions on approval of a new variety under section 32 of the Act. Regulation 4 specifies particulars to be entered in the Register of Plant Breeder's Rights with respect to applications and grant of rights. Decisions regarding grant of rights shall be published in the Journal of Intellectual Property pursuant to regulation 6.
Remaining regulations concern mainly matters of procedure and the payment of fees to be paid under the Act and these Regulations and specified in Schedule I. Regulation 11 makes provision for the opposition to grants files under section 41 of the Act. Schedule II contains forms. Schedule III specifies the quantity of reproductive material to accompany an application, whereas Schedule IV specifies the stock of reproductive material required to be maintained under section 20 of the Act.
