Abstract
The present Regulations enforce the Canada Shipping Act, 2001 (S.C. 2001, c. 26). In particular, the Regulations lay down provisions relating to the control and management of water. The Regulations apply in respect of the following vessels if they are designed or constructed to carry ballast water: a) Canadian vessels everywhere; and b) vessels that are not Canadian vessels and are in waters under Canadian jurisdiction. The text, consisting of 16 sections, deals with the following aspects: interpretation, application, compliance, ballast water management, ballast water exchange – non transoceanic navigation, ballast water exchange and treatment standards, ballast water management plan, exceptional circumstances, reporting.
