Abstract
The Act is organised in VIII Titles and 330 Sections. Title I contains general provisions applicable to every cooperative constituted, continued or resulting from an amalgamation under this Act or governed by the Cooperative Associations Act (chapter A-24) or the Act respecting cooperative agricultural associations (chapter S-24) before their replacement by this Act. The Title regulates cooperatives’ constitution, membership, powers, activities, among others.
Title II focuses on certain cooperatives: producers, consumers, work, shareholding workers and solidarity cooperatives. Under producers cooperatives are included agricultural cooperatives (Division I, Section 194-219) defined as cooperative whose principal objects are connected with agricultural or related activities, with the furnishing of goods and services required for such activities, or with the production, processing, storing, marketing, handling and transport of produce connected with such activities. Section 200 specifies that to be a member of an agricultural cooperative, a person or partnership must be an agricultural producer and a paying member that observes the by-laws of the cooperative.
Title III lays down provisions for federations and Title IV for confederations. Title V concerns Regulations and VI Penal provisions. Title VII regulates continuance of a cooperative as a business corporation and vice versa. Title VII establishes the powers of Minister and Administration to require information.
