Abstract
The Land Owner Transparency Regulation is organised in 6 Parts and gives effect to many parts of the Land Owner Transparency Act.
Part 1 and Part 2 contain definitions, in particular Part 2 defines “indirect control” for the purpose of the Land Owner Transparency Act. In Part 2 we can find under Division 1 the definition of “relevant intermediary” and “chain of relevant intermediaries” that will provide background to understand definitions and rules for “indirect control” under Division 2 and 3. Division 2 focuses on “Indirect Control of Shares of Relevant Corporation” and Division 3 on “Indirect Control of Directors of Relevant Corporation”.
Part 3 concerns transparency declarations and transparency reports; Part 4 is not yet in force; Part 5 regulates inspection and seizure of lawyers’ records; Part 4 is on administration and enforcement; Part 5 regulates how documents must be given by administrator, enforcement officer and minister depending on the person receiving the documents laying down different rules if the receiver is an individual or partner, or neither of both.
