Abstract
The present Regulations are made under section 9 of the Fisheries Act. Section 2 establishes that the Minister may impose on every lobster buyer, as a condition on a lobster buying license, a levy in the amount of one cent per pound of lobster bought by the lobster buyer at the first point of sale. The purpose of the levy is to fund the development and implementation of a marketing plan for lobster. Moreover, the Minister may enter an Agreement with a non-profit corporation or entity to act as the marketing authority responsible for: a) the collection of the levy; and b) the development and implementation of a marketing plan for lobster using the proceeds of the levy. The text – consisting of 10 sections - deals with the following aspects: definition of terms, such as buying licence, first point of sale, levy, lobster buyer, lobster buying licence, lobster fisher, marketing authority; requirements, non-profit corporation; contents of agreement; duty to remit levy; resolution of disputes.
