Abstract
For the purpose of this Act, under Part II, the Minister shall appoint a Chief Animal Welfare Inspector and may appoint one or more deputy Chief Animal Welfare Inspectors. The Act provides for the duties of the Chief Animal Welfare Inspector, training requirements and other elements; describes the role of the Minister; clarifies public information duties; and lays down the discipline for the appointment of the inspector. Part III regulates complains; any person, other than an animal welfare inspector, may make a complaint in writing to the Chief Animal Welfare Inspector about the conduct of an animal welfare inspector. Review and investigation are disciplined.
Part IV sets standards of care and administrative requirements for animals; every person who owns or has custody or care of an animal shall comply with the standards of care and the administrative requirements with respect to every animal that the person owns or has custody or care of. Exceptions are envisaged for agricultural and veterinarians. The Part specifically regulates distress, animal fights and harm, envisaging again exceptions for veterinarians and agricultural activities. Sections 18-20 regulates prohibited and restricted Animals. Sections 21-23 is on prescribed activities and procedures.
Part V regulates protection of animals; it provides for general inspection powers; it allows and disciplines entry where animal is in distress and clarifies powers. Critical distress in multivehicle is also considered. Part VI coordinates Animal Care Review Board; this include: Board rules, appeal to Board. Part VII is enforcement. Part VIII Offences and penalties.
