Abstract
The present Regulations are made under the Emergency Planning Act. At the outset the Regulations contain a definition clause relating to various terms therein employed, such as, “agricultural operation”, “assistance”, “communal organization”, “date of the disaster”, “disaster” which means an occurrence of nature that causes substantial loss of or damage to property; “disaster assistance”, “disaster assistance claim”, “educational institution”. Section 3 establishes that if a disaster occurs in an area, the following may apply to the minister to have the area designated as an eligible assistance area: a) a local government authority or a park authority having jurisdiction in the area; or b) in the case of the member of the Executive Council responsible for the administration of the Parks Act, that member of the Executive Council. The text consists of 38 sections divided into 7 Parts as follows: Title and Interpretation (I); Procedures (II); Claims (III); Limits on and Amounts of Assistance (IV); When Assistance not payable (V); General (VI); Repeal, Transitional and coming into Force (VII).
