Abstract
These By-laws shall apply to the island of Manihiki, its lagoon and reef and to its surrounding waters. These By-laws consist of 27 sections divided into 7 Parts: Free-diving (I); Pearl farming (II); Technicians (III); Natural resource management (IV); Quality control and industrial standards (V); Enforcement (VI); and Penalties (VII). These By-laws sets forth provisions on the permits for free diving, pearl shell diving and pearl farming; requirements for the technicians; prohibited activities while fishing; declaration of raui or commercial restrictions; protected and prohibited fishing areas for the protection of species; enforcement by police; and offences and penalties. Furthermore, the Council may impose terms and conditions on any person holding any permit issued under these By-laws as to the length of time between the seeding of any pearl and the harvesting and re-seeding of that pearl shell, may require the keeping the records, and may inspect any pearl farm in order to ensure quality control and meet industrial standards.
