Abstract
This co-operative fishing agreement, consisting of 14 Articles, is applicable to parts of the exclusive economic zones (EEZ) of both countries where each State will issue permits and allow the fishing vessels of the other State to carry out fishing activities in the respective EEZ. Fishing species and fishing quotas, working areas and other operating conditions shall be decided every year based on the contracting parties exclusive economic zone resources, their fishing capacity, traditional fishing activities, and other relevant factors. The decision should respect the consultation results of the Japan-China Joint Fisheries Committee created by this agreement. States additionally agreed to co-operate in scientific research on fisheries and conservation of marine living resources, as well as in providing assistance and protection to the extent possible in the event that a national or fishing vessel of one state should suffer maritime casualties in the EEZ of the other state. This agreement also established a provisional measures zone regarding parts of EEZs where States claims overlapped and where there is no accord on final maritime delimitation. The validity of the agreement is 5 years, renewable.
