Abstract
For the purpose of improving the protection of foreign geographical indication products, the China National Intellectual Property Administration has decided to amend the Measures for the Protection of Foreign Geographical Indication Products.
Main amendments include: 1. Article 5 is amended to read: ”The China National Intellectual Property Administration (“CNIPA”) shall uniformly administer the protection of foreign geographical indication products in China. The administrative departments of intellectual property at all levels shall implement protection of foreign geographical indication products in accordance with their respective functions and duties.” 2. Article 6 is amended to read: “In accordance with these Measures, a foreign geographical indication product shall apply for protection in China under the agreement concluded between the country which the product is from and the People's Republic of China, or the international treaty acceded to by China and the country, or in accordance with the principle of reciprocity.” and is renumbered as Article 3.
