Abstract
This Decision is enacted to strengthen public health security, ensure people's health and safety, protect wildlife resources, improve the capacity of bio-safety management, protect ecological security, and maintain the long-term stability of the country.
Trading and consumption of wild animals has been practised in China for centuries but has been blamed for helping to spread the coronavirus. Since the outbreak of novel coronavirus pneumonia, the Standing Committee of Fujian Provincial People's Congress has launched the legislative work quickly. There are 15 sections adopted in the Decision this time. The provisions shall come into force as of the date of promulgation.
The Decision defines the scope of wild animals and their products forbidden to eat, including: wild animals under special state protection, wild animals under special provincial protection, terrestrial wild animals with important ecological, scientific and social values announced by the competent wildlife protection authority under the State Council and other terrestrial wild animals naturally growing and reproducing in the wild environment, etc.
According to the Section 1 of the Decision, no unit or individual is allowed to produce or market the food made from the prohibited wild animals and their products, or to hunt, sell, purchase, import, export, store, transport or post the prohibited wild animals and their products for the purpose of eating, producing or selling food. At the same time, online trading platforms, commodity trading markets, catering places and other trading and consumption places, as well as operators of transportation, storage, express delivery, etc., shall not provide trading and consumption conditions, places or other services for related illegal acts.
The Decision further makes provisions for supervision, offences and penalties, etc.
